These Terms of Service ("Terms") apply to your use of trybendwise.com (the "Site") and to any purchase you make from Bendwise ("Bendwise", "we", "us" or "our"), operated by Simon Valencia DBA Bendwise, 6182 W 26th Ct, Hialeah, FL 33016, United States. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility and your account

You must be at least 18 years old, or the age of majority where you live, to place an order. If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please give us accurate and current information when you order.

2. Orders and acceptance

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel an order, for example if an item is unavailable, we suspect fraud, or there is an error in the product information or price. If we cancel an order you have paid for, we will refund you in full.

3. Prices and payment

Prices are shown in US dollars and can change at any time before you order. Payment is taken when you place your order through our secure checkout. You agree that the payment details you provide are yours or that you are authorized to use them. Any applicable sales tax is calculated at checkout.

4. Shipping

We ship to addresses in the United States. Shipping times are estimates and are not guaranteed. Risk of loss passes to you when the carrier delivers the order to the address you gave us. See our Shipping Policy for details.

5. Returns and refunds

You can return eligible items within 14 days of delivery as described in our Refund Policy, which forms part of these Terms.

6. Product use and health disclaimer

Bendwise products are general comfort and support accessories for everyday activity. They are not medical devices and are not a substitute for professional advice. If you have a knee injury, a medical condition, circulation problems or ongoing pain, talk to a healthcare professional before using a compression product. Stop using the product if you feel numbness, tingling, skin irritation or discomfort. Please use our size guides and choose the correct size. Wearing a size that is too small can be uncomfortable.

7. Product information and pricing

We try to show product colors, sizes and descriptions as accurately as possible. Colors may look slightly different depending on your screen. Prices and availability can change without notice. If we find a pricing error after you order, we'll contact you before shipping, and you can confirm the corrected price or cancel for a full refund.

8. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, to copy or scrape its content for commercial use, or to submit false orders or information.

9. Intellectual property

The Bendwise name, logo, text, images, graphics and other content on the Site belong to Bendwise or its licensors and are protected by law. You may not use them without our written permission.

10. Third-party services and links

The Site may use or link to third-party services, such as payment processors and carriers. We are not responsible for their content, policies or actions, and your use of them may be governed by their own terms.

11. Disclaimer of warranties

Except as stated in our Refund Policy or as required by law, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent permitted by law, Bendwise will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Some places do not allow these limitations, so they may not all apply to you.

13. Indemnification

You agree to indemnify and hold harmless Bendwise from claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

15. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida, unless the law where you live requires otherwise.

We may update these Terms from time to time. Changes apply from the date they are posted on this page. The version that applies to your order is the one in effect when you placed it.
